Terms
Version 2, 3 October 2026. Version 1 was dated 2 October 2026; section 7 and the buyer's section are new.
1. Who this is between
These terms are between you and Geeks Online Pty Limited (ABN 35 124 901 917), an Australian company ("we", "us"). By signing in to the website builder, publishing a site or paying for the plan, you agree to them. If you are using Geeks Online for a business, you confirm you are allowed to agree on its behalf.
2. What we provide
- The builder. A tool for making a website for your venue from our designs.
- A free preview. A web address of ours where your site can be seen. It is marked as a preview, and it comes down 30 days after you last published it. Your work stays saved in your account.
- The plan. For a fee, we serve your site at your own domain, with hosting and a security certificate, and you can change the site whenever you like.
We do not provide email, custom design, or online booking. Selling gift vouchers and passes from your site is covered in section 7.
3. Your account
You sign in with a code we email you, so whoever controls your email address controls your account. Keep that email account secure, and tell us if you think someone else has got in.
4. What you put on your site
Your words, pictures and details are yours. You give us permission to store them and show them on your site, which is all we use them for.
You are responsible for what you publish. You agree that:
- you have the right to use every picture, logo and piece of text you add;
- what you say about your venue is true, including prices, opening hours and anything a visitor is quoted as saying;
- your site is for a real business that you run or act for;
- nothing on it is unlawful, misleading, or infringes someone else's rights.
We may take down a site, or part of one, that breaks these terms or the law, or that we are lawfully required to remove. Where we reasonably can, we will tell you first.
5. Our designs and placeholder pictures
The designs, the builder and the placeholder pictures are ours or licensed to us. You may use the designs for your site with us. The placeholder pictures are only there to show how a page will look: they may not be copied or used anywhere else, and a live site does not carry them.
6. The plan, and paying for it
- Price. The price is the one shown when you pay. For Australian customers it includes GST.
- Billing. You pay in advance, by the month or by the year. Payment is taken by Stripe; we never see your card details. The plan renews automatically at the end of each period until you cancel.
- Cancelling. You can cancel at any time from the billing page in the builder. Your site stays live until the end of the period you have paid for, and you are not charged again.
- Refunds. We do not refund part of a period you have paid for, except where the law requires it (see section 10).
- If a payment fails. Stripe tries again over the following days. If it still cannot be taken, the plan ends and your site stops being shown at your domain. Your site stays saved in your account.
- Price changes. If we change the price, we will email you at least 30 days before it applies to you, and it will only apply from your next renewal. You can cancel before then.
7. Selling from your site
On the plan, you can sell gift vouchers and visit passes from your site. This section applies if you do.
- You are the seller. A buyer buys from you, not from us. You decide what you sell and at what price, you honour what you sell, and any refund, dispute or question about a purchase is between you and the buyer. We provide the page, the Buy button and the code; we are not a party to the sale.
- Your own payment account. To be paid, you open an account with Stripe through our builder, under Stripe's own terms (Stripe Payments Australia Pty Ltd, or Stripe's company in your country). Buyers pay on Stripe's page, and the money is paid into your account by Stripe, on Stripe's schedule. We never hold it, and we never see card details. Stripe may ask you for identification and may hold or refuse payments under its terms; that is between you and Stripe.
- Our share and Stripe's fee. From each sale, Stripe takes its card fee and we take 2% of the price, both automatically, so what reaches your account is the price less those two amounts. For Australian venues our 2% includes GST. We may change our share with at least 30 days' notice by email; the change applies to sales after that date.
- Codes. Each sale produces a code, which we email to the buyer and show on your account page. Honouring a code when it is presented, and marking it used so it cannot be used twice, is your responsibility. A code is not money and cannot be exchanged for cash from us.
- The law on vouchers. Gift cards and vouchers sold in Australia must be valid for at least three years from the day they are sold, and the law may set other conditions in your country. You are responsible for selling only what you may lawfully sell, and for honouring it for as long as the law requires.
- Buyers' details. Stripe gives us the buyer's name and email address with each sale, and we show them to you with the order so that you know who bought what. Use them only to serve that purchase, and in line with your own privacy obligations.
- If your plan ends. Buy buttons come off your page. Codes already sold remain yours to honour; we keep showing them on your account page for 12 months after your last sale.
- We may stop sales from a site that breaks these terms, the law, or Stripe's terms, and we may suspend selling if we believe sales are not genuine. Where we reasonably can, we will tell you first.
If you buy a voucher or pass from a venue's site
This part is for buyers. The venue named on the page is the seller, and your contract is with it. Geeks Online makes the venue's website and passes your purchase to Stripe; we are not a party to the sale.
- Paying. You pay on Stripe's secure page, in the venue's currency, at the price shown at the time. The venue, not Geeks Online, receives your money. We never see your card details.
- Confirmation. Your purchase is confirmed when payment is received, and the email with your code is the confirmation. If payment is not taken, nothing is held for you.
- Your code. Show it, or give it, at the venue. Treat it like cash: anyone with the code can use it, and it can be used once. It is subject to the venue's own conditions, which it should state on its page or when you redeem it.
- Refunds and problems. Contact the venue, whose details are on its page. A refund for a change of mind is at the venue's discretion. Your rights under consumer law, including the Australian Consumer Law for Australian venues, are against the venue as the seller and are not affected by these terms.
- Your details. We receive your name and email address from Stripe and give them to the venue with the order, as our privacy page says.
- Age. You must be 18 or older to buy.
8. Your domain
Your domain is yours. It stays registered in your name, with the registrar you chose, and we do not take control of it. To put your site on it you add a record at your registrar that points it at us.
- Keeping the domain registered and renewed is your responsibility.
- You confirm you have the right to use the domain and to point it at us.
- We do not touch your email. Changing other records at your registrar is your responsibility.
- When your plan ends, we stop showing your site at your domain. The domain remains yours to point wherever you like.
9. Keeping the service running
We work to keep the builder and your site available and secure, but we cannot promise they will never be interrupted. Occasionally we need to make changes or carry out maintenance. We may change or add to the service; if a change takes away something you are paying for, we will tell you in advance.
10. Your rights under Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms takes those rights away. If we fail to meet one of those guarantees, you are entitled to the remedies the law provides, which may include having the service supplied again or a refund.
Beyond those rights, and as far as the law allows: we are not liable for loss of profit, loss of business or other indirect loss arising from your use of the service; and our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.
11. Ending your account
You can stop using Geeks Online at any time. To have your account and everything in it deleted, email us and we will do it within 30 days. We may suspend or close an account that seriously or repeatedly breaks these terms; if we do and you have paid for a period, we will refund the unused part unless the breach was unlawful conduct.
12. Changes to these terms
If we change these terms we will update this page and its date. If the change matters to you, we will email you before it takes effect. If you keep using the service after that, you accept the change; if you do not accept it, you can cancel.
13. The law that applies
These terms are governed by the law of New South Wales, Australia.
